Terms of Use

• The following terms and guidelines are subject to change without notice.

• The graphics showcased at Yumeiroyakata are considered linkware and all public users are required to link back to Yumeiroyakata (http://www.yumeiroyakata.com/). You may not use the graphics from Yumeiroyakata if you are unable to link back.

• You may not use the graphics from Yumeiroyakata if you're unable upload html/image files to your website.

• The only desktop use allowed for Yumeiroyakata's graphics is as your personal computer's desktop background.

• Business/organization sites must apply for a user license prior to the use of the graphics. A license will be issued upon approval.

• Personal (non-profit) sites are required to register as a user. (Starting from May 2003)

• All graphics of Pastel Graphics by Yumeiroyakata, including custom-made graphics, are the copyrighted works of Yumeiroyakata/K. Pearson.

• All who enter the gallery area are considered to have agreed to these terms of use. (Theoretically there should be no violators.)

1. No Direct-Linking - You may not link directly to any images/files. NO EXCEPTIONS. The Affected images/files may be deleted off the gallery and become unavailable at any time. How do you tell if you're direct-linking? - If the name of the image file you're trying to use start with http://www.yumeiroyakata.com/... then you are direct-linking. You must download Yumeiroyakata's images first then upload them to your web server.

2a. No Copying - You may upload it to your web server and/or save it to your local hard drive to use on your desktop, but you may not copy it to any other media such as floppy disks, CD-ROMs, and other similar media.

2b. No Printing - You may not print the graphics from Yumeiroyakata on paper, fabric, or any other printable materials. You may not use the graphics from Yumeiroyakata as patterns and/or designs for arts and crafts.

3. No Reproducing - No mimicking, or imitating the graphics displayed on Yumeiroyakata.

4. No Altering - You may not change the appearance, size, colour, format of graphics from Yumeiroyakata. The graphics may not be used as the "background" for other artwork.

5. No Archiving - You may not use the graphics from Yumeiroyakata to create a library or collection in any format using CD-ROMs, online collections, or any other archive methods.

6. No Redistributing - You may not collect the graphics from Yumeiroyakata and redistribute on the web or using other media.

7a. No Commercialization - The graphics from Yumeiroyakata are not to be used for profit (actual, intended or bartered) such as web design, desktop publishing, online and/or offline publications, and distributions.

7b. No Use by Web Designers/Developers - The graphics from Yumeiroyakata may not be used by paid outside web designers and/or web developers. Also, the graphics from Yumeiroyakata may not be used on sites that "sell" web designs.

8. Licensing - A license is required for a business/organization entity. Depending on the type of your business/organization, some additional terms and/or fees may apply. More information can be found by clicking on the 'Information' link within the gallery. All requests must be approved prior to the use of the graphics.

9. Guarantee - All graphics are provided "As-Is" and Yumeiroyakata does not take any responsibility for any damages caused by the use/misuse of the graphics. Also, Yumeiroyakata is not responsible for the content of websites that use Yumeiroyakata's graphics.

10. Incorporation - You may not incorporate graphics from Yumeiroyakata into software, scripts or applications without a written consent from Yumeiroyakata.

11a. Restrictions-A - Under no circumstances may the graphics from Yumeiroyakata be used on any web sites offering or featuring any offensive and/or illegal materials. This also includes any web sites that promote "SPAM" or pyramid schemes. Sites with religious contents require permission prior to the use of graphics.

11b. Restrictions-B - If you have your own downloads (sounds, scripts, etc.), the graphics from Yumeiroyakata may not be used on any portion of your web site without proper registration as a user. Please notify the visitors to your site accordingly to avoid misunderstanding. You may not use Yumeiroyakata's graphics if your site falls into the same category: web graphics and desktop wallpaper.

11c. Restrictions-C - The graphics from Yumeiroyakata may not be used on site and/or pages that require membership registration(s) to view.

12a. Linking-back: Personal/Non-Profit Web Site Users - All users are required to link back to Yumeiroyakata. No exceptions.

12b. Linking-back: Email Users - When using Yumeiroyakata's graphics as email backgrounds, you still are required to link back to Yumeiroyakata. Please include this line in your email: Email Background Provided by http://www.yumeiroyakata.com/.

12c. Linking-back: Business/Organization Web SiteUsers - When linking back to Yumeiroyakata, you must use a graphical link on the index page or page(s) where Yumeiroyakata's graphics are used. A fee will be charged otherwise.

13. Publications - You must contact Yumeiroyakata concerning the inclusion of www.yumeiroyakata.com in offline publications including magazines, books and online and offline newsletters.

14. Violators - The name, site URL and/or email of user(s) may be announced if found in violation of the terms of use.

15. Display - You may not display contents of Yumeiroyakata within a frame of external pages.

16. Linking - You may link to Yumeiroyakata freely and without obtaining permission, however, you may only link to the index page (http://www.yumeiroyakata.com/).

* Public User: A user who intends to use Yumeiroyakata's graphics on public locations and/or situations, where graphics will be viewed by others.
